Terms of Service

These Terms of Service ("Terms") govern your use of the Photo Cleaner — Storage Saver application ("the App") published by Bulpara Inc ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Service Description

Photo Cleaner is an iOS application that finds duplicate, near-duplicate, blurry, and screenshot photos in your iPhone Photos library, then helps you batch-delete the ones you don’t want to keep. All scanning and grouping runs on your device using Apple’s Vision framework and Metal Performance Shaders. Features include exact and near-duplicate detection (Vision feature prints), blur scoring (variance of Laplacian), screenshot detection, Smart Albums (faces and scenes), cleanup history, and scheduled background rescans for Premium subscribers.

2. Important Limitations

Photo Cleaner is a recommendation tool, not an automated photo manager. You understand and agree that:

• The App suggests photos for deletion based on visual similarity, blur scoring, and metadata. You confirm every deletion; iOS shows a system prompt for every batch.
• Near-duplicate detection can occasionally group visually similar but legitimately distinct photos (e.g., two different selfies at the same location). You should review each group before confirming a delete.
• Blur scoring is heuristic. Intentional artistic blur, motion blur, and shallow depth-of-field shots may be flagged. The Premium sensitivity slider lets you tune this threshold.
• Face grouping may merge similar-looking people or split the same person across groups. Names you apply to groups stay on-device.
• Deleted items go to your Photos “Recently Deleted” album. iOS keeps them for 30 days; we have no ability to recover photos after iOS empties that album.
• The App is not a backup tool. Always ensure your photos are backed up (iCloud Photos, an external drive, etc.) before performing large batch deletions.

3. Acceptable Use

You agree to use the App only for lawful purposes and only on photos you have the right to manage. You agree not to:

• Process or delete photos belonging to other people without their permission
• Use the App to remove evidence in any legal, regulatory, or investigative context
• Reverse engineer or decompile the App or its bundled assets
• Attempt to circumvent subscription restrictions or free-tier limitations
• Use the App in any manner that violates applicable laws or third-party rights

4. Subscriptions & Billing

• Free tier: No charge. Unlimited exact-duplicate and screenshot cleanup, preview of near-duplicate and blur groups (top 10 each), with banner and interstitial advertising.
• Premium Monthly: $7.99/month. Unlimited near-duplicate and blur cleanup, Smart Albums (Faces, Scenes, Sources), scheduled background rescans, bulk “keep newest/highest-res” actions, and zero ads.
• Premium Annual: $49.99/year (save 48% vs. monthly), with a 7-day free trial. Same Premium feature set as monthly.
• Subscriptions are billed through the Apple App Store and are subject to Apple’s Terms of Service.
• Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• If you cancel during a free trial period before the trial ends, you will not be charged.
• We do not offer weekly subscriptions. This is a deliberate positioning choice, not a temporary state.
• We reserve the right to change pricing with 30 days’ notice. Existing subscribers retain their original price for the remainder of the active term.

5. User Content

Your photos, cleanup history, feature print caches, and preferences are stored locally on your device. You retain all rights to your photos. We do not access, collect, or store your photos on any server.

6. Intellectual Property

The App, including its design, code, and packaged content, is owned by Bulpara Inc and is protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for its intended purpose. The bundled machine-learning models provided by Apple’s Vision framework are governed by Apple’s licensing terms.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT GROUPING RESULTS WILL MEET YOUR EXPECTATIONS FOR A SPECIFIC LIBRARY.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULPARA INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Loss of photos resulting from deletions you confirmed via the iOS system prompt
• Decisions made based on a near-duplicate grouping or blur score
• Photos permanently removed by iOS from the Recently Deleted album after the 30-day retention window
• Subscription-related charges that fall under Apple’s billing policy

You are solely responsible for backing up your photos before performing batch deletions.

9. Indemnification

You agree to indemnify and hold harmless Bulpara Inc from any claims, damages, or expenses arising from your use of the App, including any photos you process and delete.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
